Respected Sir,
As per the call given by the Central Head Quarters of this Association
to observe the ‘Call Attention Day’ on 10-04-2012, this General Body is
calling your kind attention to the resolution of the following long
pending issues.
- Rectification of the Discrimination caused due to the promotion of Gr.D to LDC on seniority basis ignoring the seniors in the Sorter cadre: During the Strike negotiations it has been agreed to grant notional seniority to the senior sorters to redress this long pending grievance. But till date no positive action is taken. Hence, it is requested to settle this issue as assured.
- Amendment to LDC & JA recruitment Rules: The recruitment rules of LDC & JA have been amended to the disadvantage of the existing senior officials in the respective feeder cadres, who are otherwise eligible for promotion under Seniority cum Fitness quota. This sudden amendment by enhancing the educational qualification made these existing seniors disqualify for the promotion under ScF quota. Hence, it is requested to restore the educational qualification for the promotion to LDC & JA cadres under Seniority cum fitness quota.
- Cadre restructuring: The cadre restructuring of Postal Accounts is being delayed and the senior Sorters, LDCs and DEOs are retiring without taking the benefit. Hence, it is requested to expedite the action to get the proposal accepted.
- Gr.B status to Senior Accountants: This issue is pending settlement for the last two years. According Gr.B status to Senior Accountants will confer to the principles laid down by the DOP&T on the classification of posts besides adhering to the decision of the Postal Board. The DOT also accorded this status to the Senior Accountants working in their Department. The exclusion of the Senior Accountants of the PAOs from this status will create problems in future as all the Senior Accountants working in both the wings constitute a single feeder cadre for AAO promotion under ScF quota. Hence, we earnestly request for the settlement of this issue in favour of the Senior Accountants without further loss of time.
- Notification of All India Seniority List of Senior Accountants as on 01-09-2009: Though more than two years elapsed after collecting the relevant information on this matter, the final list has not yet been notified. To avoid future complications, conflicts and legal disputes among the Senior Accountants working in PAOs and DoT, it is requested to notify the All India Seniority list of Senior Accountants immediately without waiting for the AAO Recruitment Rules.
- Repatriation of the employees of PAO Kapurthala posted at PAO Jammu: This issue is pending for more than 5 years. Though it is assured that the repatriation will take place on the arrival of new recruits, no relief has been given to these displaced employees. Contentions like ‘lien’ raised by the authorities also adding further to their woes. Hence, it is requested to bestow your kind attention on this long pending human problem.
- Issues related to the DEOs of Chennai: DEO cadre at Chennai is the best example of disowning by the Official Side of its own creation. To instill confidence in the employees over the decisions taken by the authorities, it is very much essential to stop the recovery imposed on the DEOs besides conceding the genuine demand for the higher pay scale.
In addition to the above stated issues, it is brought to your kind
attention that the slow pace of recruitment in the PAOs is stifling the
functioning. Timely action is requested to quicken the recruitment
process and fill up all the vacancies before it is too late. Copy of the
Memorandum submitted in this regard to the GM Finance/D.A(P) is
enclosed for your kind information.
Many times the above stated issues have been brought to your notice, yet the issues remain unresolved. This General Body through this memorandum requests you to settle the issues so as to discourage this Association to embark upon further protest programmes.

RESOLUTION
It is announced for general information that during the year 2012-2013, accumulations at the credit of subscribers to the General Provident Fund and other similar funds shall carry interest at the rate of 8.8% (Eight point eight per cent) per annum. This rates will be in force during the financial year beginning on 1.4.2012.
The funds concerned are :-

3. The All India Services Provident Fund.
4. The State Railway Provident Fund.

Subject: Children Education Allowance/Hostel Subsidy-Clarification-
The undersigned is directed to refer to Department of Personnel
& Training’s O.M.No.12011/03/2008-Estt.(AL) dated 2nd September, 2008
and subsequent clarification No.12011/08/2010-Estt.(AL) dated 30th December,
2010 on the above subject and to say that this Department has been receiving various references
seeking clarification whether fee charged by schools for teaching through
audio-visual aids can be reimbursed. It is clarified that fee paid to the
school for the use of any aid or appliances by the child is reimbursable.
Hence, if fee is charged by the school for teaching through audio-visual tools,
the same is reimbursable as “fee” mentioned in para 1(e) of the O.M. mentioned
above.

HEALTH INSURANCE SCHEME FOR THE CENTRAL GOVERNMENT EMPLOYEES WAITS FOR APPROVAL OF PLANNING COMMISSION
New Delhi, May 18, 2012(PIB): There is a proposal for
introduction of a health insurance scheme for the central government employees
and pensioners on pan-India basis, with special focus on pensioners living in
non-CGHS areas.
The
proposal is to make this scheme voluntary cum contributory for serving
employees & pensioners.
However,
it is proposed to be made compulsory for the new entrants in Government
service.
The
salient features of the proposed Health Insurance Scheme are as under;
Optional for serving Central Government
employees and pensioners including
future pensioners,Compulsory for new recruits,Covers all the members of family
as per CGHS norms,Sum insured – Rs. 5 lakh per year on a family floater basis,Corporate
buffer of Rs 25 Crore to take care of cases exceeding Rs. 5 lakh,All pre
existing diseases covered from the day one,Pre and post hospitalisation
benefits available,
Domiciliary Hospitalisation benefit,Maternity
benefit upto two living children,
OPD not covered however OPD consultations
will be free,Payment of FMA for meeting OPD needs,Cashless treatment facility,Govt.
to subsidise significantly the payment of premium, Employees / pensioners to contribute
20 to 30 percent of the premium,Identification of beneficiaries through a Smart
Card.
The proposed scheme will be an alternative
to the CGHS and it will provide an option to the serving employees and
pensioners to choose a scheme as per his/her convenience.
The
Scheme will have special focus on the pensioners living in non-CGHS areas who
are getting Fixed Medical Allowance at the rate of Rs.300/- only per month to
take care of their medical needs and have been demanding extension of CGHS or
CS (MA) Rules to cover their OPD and Inpatient medical needs which is not
feasible due to resource constraints.
The
Health Insurance Scheme seems to be a viable alternative. It will have
additional implications, due to coverage of pensioners living in non-CGHS areas
and not covered under any Government Scheme.
The
proposal for inclusion of the Health Insurance Scheme for the Central
Government employees and pensioners in the 12th Plan has been moved by the
Ministry for consideration of the Steering Committee on Health in the Planning
Commission.
On
receipt of approval of Planning Commission, the proposal would be placed before
the Expenditure Finance Committee and finally before the Cabinet for approval
of the scheme. No strict time frame can be given in this regard.
This
information was given by the Union Minister for Health & Family Welfare
Shri Ghulam Nabi Azad in reply to a Starred question in Lok Sabha on Friday,
i.e. May 18, 2012.

An – Important CAT Decision
Abnormal delay in issuing a charge-sheet to an employee for his omissions and commissions leads to quashing of charge-sheet and also return of recovered money, if any amount is recovered from the charge-sheeted employee
Facts: While
the Applicant was working as Accountant with effect from 21.5.1996 and
BCR with effect from 1.7.2007, he was issued with a charge-memo under
rule 16 of CCS (CCA) Rules vide Memo, dated 11.12.2008 for a matter
which related to October, 1997, i.e. more than 11 years old. A recovery
of Rs1,94,791 was to be recovered as per the order of SPOs, Sitapur,
dated 27.03.2009. His appeals were rejected. Hence he filed this OA for
setting aside his punishment.
The
Applicant, Accountant-II, states that no undertaking was taken from him
in regard to recovery of amount if any amount is paid by him
incorrectly and that B. K. Tripathi, Accountant-I is fully responsible
for the lapse and an amount of Rs.24,442 only is to be recovered from
him. Further, the punishment order is non-speaking and hence liable to
be quashed.
The Respondents sustain their orders based on various instructions of the Ministry of Finance and Chief Postmaster-General of U. P. Circle, Lucknow.
They further state that an enquiry was conducted in the
misappropriation of money and four persons including the Applicant was
found responsible. Out of four, one had retired and another died. Hence
no action was taken against them The Applicant and B. K. Tripathi,
another employee were found guilty and an amount of Rs. 194791 and Rs.
24,442 respectively are to be recovered from them.
The
Applicant placed reliance on the case of P. V. Mahadevan v. M. D.
Tamilnadu Housing Board (2005 AIR SCWs 690), wherein the charge memo was
quashed due to inordinate delay. In the case of State of M. P. v. Bani Singh, reported in AIR similar view of delay led to quashing of the charge-sheet. In the case of State of A. P.
v. N. Radhakrishnan (1998 (4) SCC 154), it was held that in all
situations in respect of delay in conclusion of departmental enquiry may
vitiate the proceedings. Following these judgments, the tribunal passed
similar orders in O. A. No. 427 of 2006. Jhabbar Yadav v. Union of
India and others decided on 16.10.2008.
The
Tribunal considering the delay in this case of 11 years which pertained
to a case 11 years back examined the issue of charge-sheet and
punishment thereon. The two employees now punished reportedly committed
the mismanagement of money and on the pretext of having given and
underataking for recovery, if found guilty is not sustainable. In that
connections. It was held:
Held: “In
view of aforesaid discussion, we come to the conclusion that there was
an inordinate delay of about 11 years in issuing the charge-sheet for
initiating disciplinary proceedings for which there is no proper
explanation from the side of the Respondents. Therefore, having regard
to the aforesaid preposition of law laid down by Hon. Apex Court (Supra)
in the above cases, the disciplinary proceedings in question, deserved
to be quashed, including order of recovery against Applicant initiated
through charge-sheet, dated 11-12-2008 along with recovery Order, dated
27.03.2009. for the same reasons, the Appellate Order, dated 29.6.2009
is also liable to be quashed and accordingly it is so ordered. It is
further directed that the amount already recovered, if any from the pay
of the Applicant, shall also be refunded.”
The OA is allowed accordingly to the above extent.

for providing annuity services to the subscribers of National Pension
System
Subscribers
to the National Pension System (NPS) will now have a choice of Annuity
Service Providers, from whom they can choose their annuity schemes on
their exit from NPS on attainment of 60 years of age. Pension Fund
Regulatory and Development Authority (PFRDA) has empaneled the
following six IRDA approved life insurance companies for providing
annuity services to the subscribers of National Pension System (NPS).
1. Life Insurance Corporation of India
2. SBI Life Insurance Co. Ltd.
3. ICICI Prudential Life Insurance Co. Ltd.
4. Bajaj Allianz Life Insurance Co. Ltd.
5. Star Union Dai-ichi Life Insurance Co. Ltd.
6. Reliance Life Insurance Co. Ltd.

It may be mentioned that under the provisions of NPS, a maximum of 60%
of corpus accumulated at the time of exit, normally on the attainment of
60 years of age, can be withdrawn but a minimum of 40% corpus has to be
utilized for purchasing an annuity from one of the empanelled annuity
service providers. Subscriber can choose from any of the six above
mentioned annuity service providers and can also make their choice of
the annuity scheme from amongst the schemes being offered by these
providers.
3. With the above empanelment, PFRDA has taken an important step towards providing an exit route to the subscribers.

Dear Sir/Madam,
With the approval of the
Secretary a Committee for Organizational Restructuring in the Department of
Posts has been constituted under the Chairmanship of Shri Ashutosh Tripathi,
CPMG, Madhya Pradesh Circle. The Terms of Reference of the Committee are:
a) To revisit the norms for
creation of new Postal Divisions and Regions as well as upgradation of Class II
Division into Class I Division
b) To study the feasibility of organizational restructuring of field
formations (Circle and below) keeping in view the emerging needs for India Post
in the new socio-economic environment;
c) Review of norms for upgradation of Post offices;
d) To
study the feasibility of strengthening / creation of Postal Assistants /Sorting
Assistants Posts in view of the increased need of Systems Administrators;
e) Any other relevant issue as may be assigned by the Competent Authority later.
2. The Committee is at present examining the feasibility of Organizational Restructuring
of field formations (Circle and below) keeping in view the emerging needs for
India Post in the new socio-economic environment as well as induction of
technology in the Department. While deliberating on this, the Committee
has decided to obtain valuable inputs from the concerned stakeholders.
3.
In the light of the above, you are requested to kindly provide your considered
views on what, according to you are the problems (both administrative and
operational) in the current Organizational set up and what could be the
possible revised structure for all category of Offices that could address these
problems with the given human & financial resources.
4. On the basis of various discussions that the Committee Members have held with
the other Officers, possibility of creation of Vertical Silos has also
emerged. You may also give your views on this clearly identifying the
possible Silos given the nature of the work in the Department of Posts not only
as per the current scenario but also the possible one in the next decade; along
with their possible structures; responsibility, financial; and reporting system
etc. The possibility of extending the Silos till the Head Post Office may
also be considered.

DECISIONS OF NATIONAL EXECUTIVE MEETING HELD AT KOLKATA

Dear Comrade,
The National Executive meeting of the Confederation was held at Kolkata on 28th April 2012 as scheduled. The meeting was chaired by Com. S.K.Vyas, President. Of the 27 members of the Sectt., twenty comrades attended the meeting. Com. D.P.S Madan and Com. Seethalakshmi did not attend the meeting. The other five comrades had intimated their inability due to unavoidable circumstances to be present at Kolkata. Eighteen National Executive Members
representing affiliated Associations/Federations having more than 3000
members did attend the meeting. The prominent absentees were the
representatives of: (a) Central Sectt. Employees Federation, (b) CPWD
Workers Union (c) CGHS employees Association and (d) Marine Engg.
Employees' Association. However, the following
affiliates, even though having less than 3000 membership, sent in their
representatives to attend the meeting as observers.
Farakka
Barrage Engineers Association, Farakka Barrage Group D Employees
Union, NSSO Ministerial Staff Association, Botanical Survey of India
Employees Association, ICMR Employees Association, National Library
Employees Association. Of the 18 State Committees, barring Gujarat,
Rajasthan, North West Region (Haryana and Punjab) and Himachal Pradesh,
all sent in their representatives to attend the meeting. It was, therefore, the best attended National Executive meeting of the Confederation. We thank profusely the comrades who took the trouble to make it possible. The West Bengal State Committee had made very good arrangements for the conduct of the meeting. Excellent food and very good lodging arrangements had been there. The decisions taken at the meeting are briefly placed hereunder:
1. At
the request of the house, Com. President agreed to include to discuss
the organisational matters and organisational review was included in
the agenda.
2. Agenda No.1: Programme of Action - Unanimously decided to organise a March to Parliament on 26th July, 2012(Thursday) with a participation of about 50,000 comrades.
3. Series of demonstrative action programmes will be carried out during the months of August to November, 2012.
4. The programme will be culminated in a One day Strike on a date to be fixed by the Sectt. and announced at the rally on 26th March, 2012. The
proposed one day strike will be on a day between the last fortnight of
November and the first week of December, 2012, depending upon the
period of the Monsoon session of the Parliament.
5. Agenda No. 2: Campaign programmes - The first phase of the campaign programme will be concluded by 20th July, 2012. The National leaders will visit all States. Meetings will be organised at least in three places in each State. The
State Committee immediately on receipt of this communication will
decide upon the tour programme for each station in the State. The
affiliates will book accommodation at Delhi for the participants who
will have to reach Delhi a day prior to the programme. The Comrades who will be going over to Delhi may be advised to book both the to and fro journey tickets. The Tour programme of the National leaders is given in the annexure to this Circular. Both
the State Committee and the deployed comrades may seek changes in the
date and place within one week of the receipt of this communication. Whatever adjustments are possible, it would be done by the CHHHQ.
After a week no change could be possibly done. The State/District
Committees and the affiliates" State leadership will ensure that the
railway tickets are booked immediately and the list of volunteers to
participate in the March to Parliament programme finalised. The States
Committees of Uttar Pradesh, Rajasthan, Delhi and Madhya Pradesh are
specially requested to mobilize large number of comrades who are
stationed in and around Delhi for participation in the March to
Parliament programme. If necessary they may hire buses etc. to bring the participants.
6. Review of 28th Feb. 2012 Strike participation:
As per the reports presented by both the State Committee and the
affiliates, it is evident that the strike participation of CGEs on 28th
Feb. 2012 had surpassed all records and have enthused the rank and
file of the workers. Most of the comrades reported that the proposed
strike action in November/December, 2012 will have larger participation
of CGEs in view of the CGE specific demands in the charter. It
emanated from the discussion of the organizational review that the
organizational state of affairs in North West Region and Gujarat is
quite pathetic and serious attention to revive the functioning of the
state Committees must be made. The U.P State Committee will hold their
conference in June, 2012. The State Conference
of Orissa has already been held and a new set of office bearers have
been elected. The Trineal State Conference of Conference was held with
participation of all District Committees. The State Committees have
been formed in Uttarakhand, Jharkhand and Chattisgarh. The
continued inability of H.P. State Committee to participate in the
strike action as well as in the NE meetings has been noted and it was
decided that the National leaders must pay attention to this aspect
immediately. The Rajasthan State Committee's Conference is overdue and steps must be initiated to hold the Conference. In
many districts of Tamilnadu, Committees are yet to be formed and the
State Committee's repeated assurance in the matter has not been
fructified.
Many
affiliates have reported the non functioning of the JCM Departmental
and Office councils and the non grant of recognition despite completion
of all formalities. The assigning of Group B.
Non Gazetted Ministerial status to the employees with grade pay of Rs.
4200 has created problems for many organisations. Taking
all these into account, the Committee decided to hold demonstration in
front of all offices and send the following telegram to the Cabinet
Secretary and the Secretary Personnel respectively. The demonstration
is to be organized in front of all offices on 25th May, 2012 and the following telegrams/savingrams sent:

REQUEST
FOR ISSUANCE OF DIRECTIVE TO ALL DEPARTMENTS TO HOLD DEPARTMENTAL
COUNCIL MEETINGS AND GRANT RECOGNITION TO SERVICE ASSOCIATION WHEREVER
THE ASSOCIATIONS HAVE COMPLIED WITH THE CCS(RSA) RULES.

KINDLY CONVENE THE NATIONAL ANOMALY COMMITTEE MEETING AND SETTLE THE ANOMALY ITEMS IMMEDIATELY.
7. Many comrades who participated in the discussion agreed with Com. T.K. R. Pillai that the 6th CPC has done great injustice to the cadre of LDCs and UDCs and the MACP scheme has compounded it. The
restructuring of the UDCs cadre in the Central Sectt. has accentuated
the injustice and has disturbed the parity which had all along been in
existence with the Sectt and subordinate office staff. The
decision of the Govt. was in complete contravention of the 6trh CPC
recommendation to the effect that there must be parity in the pay
scales of Sectt and staff in the subordinate offices. The restructuring
ought to have been automatically extended to all field formation as
the Department of Personnel is the nodal cadre controlling authority for
all common categories, he added. The house,
hearing the views of others, decided that the National leaders should
immediately take up this matter as also the settlement of MACP related
issues with the Government by holding discussions.
8. The other suggestion that has emerged from the discussions were:
(a) The
National leadership of affiliated Associations should pay visit to the
States periodically and the problems of the employees discussed;
(b) The
CHQ must monitor and ensure that the State conferences are held within
the time schedule prescribed under the constitution;
(c) The
Confederation's decisions must be endorsed by all affiliates and
communication to that effect issued to all field formations with copy
to the State Committees and CHQ.
(d) The
CHQ leaders will interact with the leaders of CGHS and Central Sectt.
To elicit their participation in the Confederation meetings.
9. The
meeting also discussed the probability of the PFRDA Bill getting
enacted in this session of the Parliament, especially in the background
of the stated position of the BJP to support such an enactment. BJP seems to have watered down its avowed position and they may not perhaps insist upon guarantee even for a minimum pension. If not altogether dropped, they may allow it to be reduced to a pittance The
meeting was of the opinion that the Confederation as decided earlier,
must register its opposition to the bill as and when it is taken up for
adoption, through a separate programme. Accordingly,
it is decided that a demonstration for two hours on either the day the
bill is taken up in the Parliament for discussion or the next day must
be organised.
The
State Committee and the affiliates are requested to kindly take the
campaign programme very seriously as an intensified and widespread mass
contact will not only rejuvenate our movement but will also ensure

NFPE- 15,000; ITEF- 2000; AIAAA- 1000; NFAEA- 1000; Civil Accounts- 500; Ground Water Board-300;
Central Secretariat- 200 all other affilitates of Confedertion: 50 each.
State
Coordination Committee may mobilize the following number of
participants from the affiliates of Confederation other than the above
organizations:
Kerala- 50, Tamilnadu- 50; Karnataka-20; Andhra Pradesh- 20; Maharastra-30; Rajasthan- 20; Delhi-100;
UP- 50; Bihar& Jharkhand- 25; M.P& CG-25, Orissa- 20; West Bengal- 50; N.E. Region-20.
